Terms of Use
These Terms of Use ("Terms") set forth the conditions for using the
"MotiMoti" application ("Service") provided by Shohei Nakagawa
("Developer"). Please read these Terms carefully and agree to them
before using the Service.
Definitions
- "User": Anyone who uses the Service.

"Video Content": Videos that the User selects from the device's photo
library or imports as files and plays with the Service.

"Settings Data": Playback settings the Service saves per video, such
as clips, drawings, playback speed, repeat, and flip settings.

"Personal Information": Information that can identify a specific
individual such as name, address, phone number, or email address.
Consent to the Terms
Users may use the Service only after agreeing to these Terms. When a
User downloads the Service to a smartphone or other device and completes
the procedure to agree to these Terms, a usage agreement under these
Terms is deemed to have been concluded between the User and the
Developer.
Changes to the Terms
The Developer may change these Terms without the User's prior consent.
The revised Terms will take effect when the Developer notifies Users by
a method separately prescribed by the Developer. If a User continues to
use the Service after such changes, the User is deemed to have agreed to
the revised Terms.
Notices

The Service assists in reviewing motion in videos through features
such as slow-motion playback, frame-by-frame stepping, section
looping, reverse playback, and on-screen drawing. It does not
guarantee any training results or improvement.

Playback speed, frame display, seek position, and similar values may
contain errors depending on device performance and video format, and
their accuracy is not guaranteed.
Video Playback and Data Handling

The Service plays videos from the photo library and imported video
files on the device. Video Content is never sent to or stored on the
Developer's servers.

Using videos in the photo library requires permission to access the
device's photo library. This permission can be changed at any time in
the device settings.

Settings Data is stored only on the User's device. The Developer has
no obligation to restore Video Content or Settings Data lost due to
app deletion, device changes, or other causes.

Some features, such as frame-by-frame stepping and reverse playback,
may not be available depending on the video format or codec.
Rights to User Content
Users shall use only videos for which they hold the rights or have
obtained permission from the rights holders. Any dispute with a third
party regarding Video Content shall be resolved at the User's own
responsibility and expense.
Privacy and Data Handling

The Developer may collect only anonymised usage statistics (e.g. error
logs, feature usage) to improve the Service. Such data cannot be used
to identify individual Users.

Collected statistical information is stored and analyzed in a form
that cannot identify individuals and is used solely for service
improvement.

Prohibited Acts
- Using the Service for unlawful purposes.

Acts that infringe the copyrights, portrait rights, or other rights of
third parties.
- Acts that violate laws or public order and morals.
- Acts that interfere with the operation of the Service.
- Any other acts the Developer deems inappropriate.
Disclaimer

The Developer shall bear no responsibility for any damages arising
from the use of, or inability to use, the Service.

The Developer shall not be liable for any damages arising from the
loss or corruption of Video Content or Settings Data, or from
inaccuracies in playback or measurement.

The Developer shall not be liable for any damages arising from changes
to, interruption of, or termination of the Service.

Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the
laws of Japan. Any dispute between the User and the Developer in
relation to the Service shall be subject to the exclusive jurisdiction
of the Osaka Summary Court or the Osaka District Court.
In-App Purchases

Some features (Pro features such as automatic saving of per-video
settings, frame-by-frame stepping, playback at up to 10x speed, and
unlimited reverse playback) may require a subscription or one-time
purchase plan.

Subscriptions allow continuous use through regular renewals, while
one-time purchase plans allow permanent use with a single payment.

The contents, pricing, and conditions of subscriptions will be
provided within the app or in the store.

The contents, pricing, and conditions of one-time purchase plans will
also be provided within the app or in the store.

Subscriptions are billed based on a contract between the User and each
app store.

One-time purchase plans are also billed based on a contract between
the User and each app store.

To cancel subscriptions, follow each store's procedure at least 24
hours before the renewal date.

One-time purchase plans cannot be refunded or cancelled after
purchase.

Refunds are subject to Apple's refund policies and procedures. For

Apple's refund support page.
Use of Brand Images
The Service's brand images (logos, icons, etc.) may be used free of
charge for both commercial and non-commercial purposes. However, use
that is contrary to public order and morals, or that may cause
misunderstanding, is prohibited.
